Karmelo Anthony was convicted of first-degree murder in the death of Austin Metcalf on June 9 and filed a notice of appeal on Wednesday, June 10. According to David Coale, a Dallas appellate attorney, Anthony’s team has strong arguments on an appeal centered on whether the trial was handled correctly.
“What stuck out to me, No. 1, was the all-White jury,” said Andrew Anthony, Karmelo’s father. Leading up to the trial, there were 12 jurors and six alternates from a pool of 589 prospective jurors.
All qualified African American jurors were dismissed by the prosecution, who argued that the case was “race-neutral” and did not require a diverse panel of jurors. Court Judge John Roach Jr. overruled the objection.
Currently, it is unknown what Anthony’s appeal will be for. After submitting the notice of appeal, Anthony also stated that he was “[a] penniless, destitute, and indigent person too poor to employ counsel to represent me on the appeal” and requested the court to provide him a representative.
